By creating an account, downloading, installing, or using the TerraSentri mobile application ("App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our App or services.
TerraSentri is an emergency alert platform that provides timely notifications about natural hazards and emergencies in the Philippines, including but not limited to:
Our service aggregates data from official government sources including PHIVOLCS, PAGASA, DOH, and local government units to deliver timely alerts to users based on their location.
To use TerraSentri, you must create an account using Google Sign-In or Apple Sign-In. You agree to provide accurate, current, and complete information during the registration process.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.
You may use TerraSentri for personal, non-commercial purposes to receive emergency alerts and safety information. You agree to use the service in compliance with all applicable laws and regulations.
You agree not to:
TerraSentri requires access to your device location to provide location-based alerts. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. You may disable location services at any time through your device settings, but this may limit the functionality of the App.
By enabling push notifications, you consent to receive emergency alerts and safety notifications from TerraSentri. You may disable push notifications at any time through your device settings or the App settings.
TerraSentri aggregates data from official government sources and third-party providers. While we strive to provide accurate and timely information, we do not guarantee the accuracy, completeness, or timeliness of any alerts or information provided through the App.
THE APP AND ALL INFORMATION, CONTENT, AND SERVICES PROVIDED THROUGH THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TerraSentri is not a substitute for official emergency services. In case of emergency, always contact local emergency services (911 in the Philippines) or follow official government instructions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERRASENTRI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless TerraSentri and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
The App and all content, features, and functionality (including but not limited to software, text, graphics, logos, icons, images, and data compilations) are owned by TerraSentri or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes in accordance with these Terms.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall be resolved through good faith negotiations. If the dispute cannot be resolved through negotiations, it shall be submitted to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TerraSentri regarding the use of the App and supersede all prior agreements and understandings.
